On Tuesday, the New York Times reported that U.K. and EU officials have reached a provisional Brexit agreement. Though as of this recording, the text of that agreement has not been released, we at Lawfare thought it a good time for a refresher on how senior Europe experts and British officials are thinking about the U.K.’s split from the European Union. On October 23, the Brookings Center on the United States and Europe hosted a panel discussion on the endgame of the Brexit negotiations with Sir Kim Darroch, Britain’s ambassador to the United States; Amanda Sloat, senior fellow at Brookings; Douglas Alexander, former U.K. shadow foreign secretary; and Lucinda Creighton, a former Irish minister for European affairs. Edward Luce of the Financial Times moderated the discussion.

They talked about some of the thorniest issues at stake in Britain’s departure, including the unresolved trade issues between the U.K. and the EU, how Scotland—whose residents overwhelmingly opposed leaving the EU in the 2016 referendum—may react to Brexit, and the risks Brexit poses to a peaceful future in Northern Ireland.

In the week since Donald Trump’s party lost control of the House of Representatives, ensuring that his criminal scandals are about to become the nation’s focus, we’ve all seen him acting in an increasingly unhinged fashion while pulling away from the most basic aspects of the job. Behind the scenes, things are even worse. Far worse.



Donald Trump is circling the drain so swiftly, his own people are rushing to the media to sound the alarm – and many of them are cracking up as badly as he is. For instance, some of Trump’s people are telling MSN that since the midterms, he’s retreated into a “cocoon of bitterness and resentment” and they’re all trying to keep their distance from him. Another Trump insider is telling Politico that Trump has become so withdrawn, allowing his people to run amok in the process, his White House has become something out of a Maury Povich episode.




In other words, Trump is not a guy who’s eagerly, or even somberly, gearing up for the impending fight of his life. Instead he’s falling apart and withdrawing, isn’t bothering to do what it takes to try to protect himself, isn’t bothering to do the job, and isn’t even interested in keeping up appearances.


This all comes even as Donald Trump’s lawyers are finalizing his answers to Robert Mueller’s questions about Donald Trump Jr’s Russia crimes, even as Mueller is apparently just days away from handing down indictments. Trump’s one post-midterms gambit, the weird and risky move of installing Matthew Whitaker at the DOJ, is already falling apart. Oh, and here come the subpoenas – and Trump clearly isn’t ready for any of it.

Over the weekend, Palmer Report explained that while the new Democratic House majority obviously intends to destroy and oust Donald Trump, the most effective way to do that is not to immediately jump into impeachment proceedings. Instead, the best chance of impeachment actually working is if the Democrats use their newfound subpoena power and committee hearing control to severely weaken Trump first. Sure enough, here comes the boatload of subpoenas.





Internally, House Democrats are preparing to launch a “subpoena cannon” in the direction of Donald Trump and everyone in his orbit, according to Axios. In all there are at least eighty-five different targets for these subpoenas. In our estimation, that’s enough to include Trump’s cabinet, his White House advisers, his campaign advisers, and his family.


It’s also worth keeping in mind that when the House Intelligence Committee was under Republican control, various Trump-Russia figures raced to testify before the committee, so the committee could falsely declare their innocence. The trouble for them now: their testimony is still on record, and now it’s about to fall under control of House Democrats. If any of Trump’s people lied during their testimony, look for quick criminal referrals on the part of incoming committee chairman Adam Schiff.

Last night Donald Trump’s newly installed Acting Attorney General Matthew Whitaker blinked by announcing that he was going to seek advice from Department of Justice ethics officials as to whether he needed to recuse himself from the Trump-Russia investigation. Whether Whitaker is serious about recusing or not, he just made it a lot easier for Democrats to ultimately force him to recuse, because he just admitted to a potential conflict. Even as this plays out, Democrats move forward with their strategy to force Whitaker out.



Half of the strategy consists of challenging Donald Trump’s claim that Attorney General Jeff Sessions resigned voluntarily. The options for DOJ succession are dramatically different depending upon whether Sessions resigned or was fired. Democratic Senator Dianne Feinstein officially called for Senate Judiciary Committee hearings today, with Whitaker and Sessions both testifying. The key here: Feinstein states that Sessions was “forced out of his position.”




This lines up with Sessions’ words in his resignation letter, in which he stated that he was resigning at Trump’s request. If the Democrats can get this to stick, it’ll mean that Donald Trump wasn’t in position to arbitrarily appoint an outsider like Whitaker to replace Sessions, even on an acting basis. It’s not clear if the GOP-controlled Senate will allow these hearings to happen. But if not, House Democrats can hold a similar hearing once they take majority control.


The second half of the Democrats’ strategy involves battling it out in court right now, thanks to the handiwork of the Maryland Attorney General. He’s trying to get a federal judge to rule that Matthew Whitaker is not legally the Acting Attorney General, despite having been appointed, and that Deputy Attorney General Rod Rosenstein still has control over the Trump-Russia investigation. In any case, it’s clear the Democrats aren’t taking this lying down.

For a bit of time, Rudy Giuliani, an attorney for “President” Donald J. Trump, disappeared. Nobody missed him while he perhaps was scrambling around to find some money to pay for his own legal bills. After the midterm elections, in what would be considered an Onion-esque headline if not for the fact it was in Newsweek, we read, “Rudy Giuliani: Obama should be ‘more presidential’ like Donald Trump, midterm results proof.”



Rudy Giuliani tweeted: “The DeSantis/Scott team won critical races in Florida. Also there was no place President Trump campaigned harder and it paid off. The big loser former President Obama looks like defeats wherever he worked hard. Maybe now he will follow 43’s more presidential approach.”




Giuliani is either referring to George W. Bush, who was the 43rd president, or to his own boss, Donald Trump. In any case, 45 shortly after engaged in his normal unpresidential style, throwing all kinds of Republicans under the bus, ridiculing them for not being MAGAts, etc. Then the “President” went off to Paris and holed up in his hotel, skipping solemn remembrances, avoiding the crowd, wasting taxpayer dollars. He attacked California for somehow not doing a better job of containing wild fires, with the emphasis on wild. On Veteran’s Day, the “President” skipped Arlington and the solemn ceremony there because of rain.


So Rudy Giuliani can talk all he wants about President Obama needing to be more presidential, but unfortunately, nothing Trump does goes without putting a further blight on the office of the President which he currently occupies. There is nothing presidential in ignoring our military, both active and veterans alike, or attacking victims of natural disasters. We will not miss Giuliani if he goes back to whatever it is he does when he is not spewing nonsense.

In the several weeks since George Papadopoulos was sentenced to fourteen days in prison as part of the Trump-Russia scandal, he’s posted one increasingly bizarre conspiracy theory on Twitter after another. He’s tried to paint himself as victim of a setup on the part of the intel community and Professor Joseph Misfud. Now suddenly Papadopoulos’s defense attorneys have decided to quit, just as Misfud is coming forward to cooperate with the Trump-Russia investigation.



The news broke this afternoon that Misfud, who has long been in hiding and was believed by some to perhaps be dead, is now seeking to testify before the Senate about the Trump-Russia scandal. Although the Senate is still under GOP control, the Senate Intel Committee probe into Trump-Russia has largely been run in an honest and bipartisan manner.




The big question is what’s prompted Misfud to suddenly decide that his best bet is to cooperate. It could be that he thinks Special Counsel Robert Mueller is about to get him anyway, or that he thinks his life may be in danger, or something else entirely. But what stands out is that, just as this story about Misfud was breaking, the AP announced that Papadopoulos’ attorneys filed a motion to withdraw from the case. Because the Papadopoulos case is ongoing, they’re not allowed to quit without a reason, and they’ll have to convince the judge that their reasoning is valid. But it’s clear they’ve decided to quit.


So what’s really going on here? Robert Mueller revealed in court filings earlier this year that he blamed George Papadopoulos’ dishonesty for the fact that Professor Misfud was able to flee the United States to begin with. Now Misfud suddenly wants to come back and plead his case, and Papadopoulos’s lawyers suddenly want nothing to do with him. There’s clearly more going on here than meets the eye. Stay tuned.

Special Counsel Robert Mueller has been busy today. He’s reportedly indicting far-right conspiracy theorist Jerome Corsi in relation to the Trump-Russia scandal. Now, as it turns out, Mueller has just backed Donald Trump into a corner when it comes to Donald Trump Jr’s criminal culpability in the scandal.



It’s long been widely reported that Donald Trump and his criminal defense team were working on written answers to Robert Mueller’s questions, but it’s always been assumed that those questions were limited to obstruction of justice. Instead, the questions are about Trump-Russia election collusion, according to Reuters. Specifically, they’re focused on Donald Trump Jr’s meeting with Russian government representatives at Trump Tower during the election. This now leaves Trump with an impossible choice.




Donald Trump can try to pin the entire thing on his son by insisting that he had no knowledge of the meeting. In so doing, Trump might protect himself from criminal culpability, but he’d be helping to ensure that his son goes to prison. In addition, if Mueller can catch Trump lying about his own role, then Mueller can nail Trump for lying to federal investigators, which is a felony. Trump’s only other option would be to tell the truth and incriminate himself in the name of trying to lessen his son’s criminal culpability, which – given Trump’s sociopathic nature – seems unlikely.


No matter which way Donald Trump goes with this, there is no remaining doubt that Robert Mueller is seeking to indict Donald Trump Jr. Does this mean that Mueller’s endgame involves putting Junior in handcuffs and using it as leverage to finish Trump off? It’s worth noting that Jared Kushner also attended that meeting, though his role appears to have been less central.
