Oh, Rudy. Donald Trump’s hapless criminal defense attorney Rudy Giuliani just keeps finding ways to walk into traps that have been set for him by Robert Mueller, or by the media, or for that matter traps of his own making. This time Rudy has stepped in it so thoroughly, he’s going off the deep end on a level that’s noteworthy even by his frantic standards.




Over the weekend Rudy Giuliani appeared on ABC This Week and asserted that Donald Trump never signed a letter of intent for the Trump Tower Moscow project. In Rudy’s view, this confirmed that there never really was a deal between Trump and Putin during the 2016 election. But then, like clockwork, by Tuesday evening, CNN suddenly had its hands on a copy of the letter of intent, complete with Trump’s signature. We’re not entirely sure how that happened, but obviously, someone was playing Rudy like a fiddle. He’s not taking it well.




Come to think of it, we’re not even sure if Rudy was lying about the letter, or if he’s so far out of the loop, he never knew about it. Either way, now that he’s playing the fool when it comes to such a crucial smoking gun, he’s reacting rather poorly. Rudy is now insisting to the New York Daily News that the letter is “bullshit” even though Trump signed it. This is the same letter that, just two days earlier, he claimed hadn’t been signed by Trump. Of course now Rudy is refusing to admit that he ever claimed it wasn’t signed.



Although Rudy Giuliani is nearly always in a vaguely rattled and confused state these days, he does tend to get far more flustered and dumbfounded when he knows things are going very wrong for him and Donald Trump. So it’s notable that Rudy is going all the way off the deep end, and then some, when it comes to this signed letter of intent. Either he thinks it’s truly a smoking gun, or he’s realizing that Trump hasn’t even told him the ugly truth about half this stuff, or both.

Over the weekend, Palmer Report brought you the story of how recently confessed Russian spy Maria Butina is already being tapped to testify before a grand jury, which strongly suggested to us that the first arrests as a result of her plea deal could be imminent. Now it turns out there’s more to the story, and federal prosecutors just confirmed that the first arrest or arrests are indeed – ahem – imminent.




It turns out the court wasn’t supposed to publicly reveal that Maria Butina was being tapped for grand jury testimony. For obvious reasons, her safety is potentially at risk, and so the whole thing was supposed to be under seal. After the court accidentally exposed this part of the story, Butina asked the judge to go ahead and unseal the entirety of the proceedings. But federal prosecutors pushed back, asking it to remain sealed, and they gave away something in the process.




Prosecutors told the judge that they want to keep Maria Butina’s case under seal for two reasons, as discovered in court filings by Rachel Maddow tonight. One is that Butina could potentially renege on her plea deal, and prosecutors have to put her on trial, which they acknowledge is unlikely. The other is that there are going to be “imminent” criminal proceedings in play as a result of Butina’s deal. Prosecutors even went so far as to place the word “imminent” in italics, to underscore their point. So what does this tell us?



In short, someone is about to get arrested as a direct result of Maria Butina’s plea deal. The most obvious candidate is her boyfriend (or presumably now former boyfriend), Republican political operative Paul Erickson, who has already received a target letter from prosecutors. If Erickson is imminently arrested and then immediately cuts a plea deal, we could see the downfall of various complicit Republican Party figures soon thereafter.

Donald Trump spent the entire election making vicious and obviously false accusations against Hillary Clinton’s charitable foundation. In hindsight that was merely Trump’s habit of projection at work, as his own “Trump Foundation” has turned out to be a nonexistent charity and nothing more than a front for his own criminal grifting. Now that it’s finally been shut down by New York state, Trump isn’t exactly taking the news well.




Trump went on a lie-filled tirade this morning, and he may have given some things away in the process. For instance, he claimed that “The Trump Foundation has done great work and given away lots of money, both mine and others, to great charities over the years – with me taking NO fees, rent, salaries etc.” Uh, no. Its financial records are public, and there is no evidence of any legitimate charitable activity in a decade. Interestingly, that’s right around the time it’s believed that Trump was fully wiped out by the 2008 economic crash, and had to turn to shady foreign investors to bail him out, and they still own him to this day.




Donald Trump went on to insist that “I wanted to close the Foundation so as not to be in conflict with politics.” This is also a lie. He did try to shut down the Foundation late in 2017, long after New York state had started investigating. At that time the state told him he wasn’t allowed to, because it knew he was simply trying to destroy the evidence.



Trump also claimed that “The new AG, who is now being replaced by yet another AG (who openly campaigned on a GET TRUMP agenda), does little else but rant, rave & politic against me.” Current New York AG Barbara Underwood has never ranted in her life, so it’s clear that Trump is projecting here. Incoming AG Tish James simply ran on a platform of bringing Trump to justice for his crimes. Then Trump added “Will never be treated fairly by these people.” In his mind, forcing people to follow the law is unfair – which tells you all you need to know about him.

On October 10th, 1973, the words “nolo contendere” (Latin for “I do not wish to contend”) were unceremoniously introduced into the popular lexicon. It was on that date that Vice President Spiro Agnew entered those words as a plea to ensure he would not be prosecuted for corruption, in exchange for a $10,000 fine, three years’ unsupervised probation, and giving up the vice presidency itself. As agreed, Agnew resigned.




Is Donald Trump in the same position? MSNBC’s Chris Matthews thinks he is, and, Matthews further believes, the window of opportunity is closing in which Trump can trade on his presidency. “Leverage the office while you still have it,” Matthews advised. Donald Trump has that window of opportunity for the time being, but that window will get narrower by degrees. Once the Democrats have control of the House the process of “death by a thousand cuts” will begin, and that process may very well extend past a point of no return. Once that point is reached Donald Trump may no longer be able to negotiate advantageous terms.




If before that happens he can negotiate a sufficiently advantageous deal with Robert Mueller and state prosecutors, he might be able to get the same deal Agnew got, or something very like it, involving little or no jail time. As Matthews puts it, “But what if the prosecutor were to offer the president an alternative? What if he were to say he would let the children walk if the old man does the same? That would mean giving up the presidency in exchange for acquittals all around ― not just for himself, but for all his kids.”




It is, of course, unclear whether or not Robert Mueller would agree to such a deal. We simply don’t know. One thing is clear, however, there would be no harm in finding out. Trump could make discreet inquiries, just like Agnew did. And say what you like about Spiro Agnew, but one thing he wasn’t was stupid. Donald Trump, on the other hand, is an appallingly stupid man. He may just miss his last window of opportunity, and before too long, get to spend the remaining leisure moments of his life regretting it.
