Yesterday we all learned that the master company in Robert Mueller’s secret appeals court case was attempting to get the Supreme Court involved. Now it turns out the Supreme Court has gotten involved, at least preliminarily, and it’s set things on a very quick timetable for a potential resolution. There are also some surreal revelations surfacing about what really went on at the appeals court level.




Chief Justice John Roberts has decided to put a hold on the appeals court ruling, but only through December 31st, so that the Supreme Court can review the matter and decide whether to take it up, according to CNN. This is not a surprise, given the unique importance of the case, which has led to unprecedented levels of secrecy. So what now?


This is not an indication that Roberts thinks the mystery company has a valid case, or that he thinks the Supreme Court should even hear the matter. It simply means that he considers it important enough to give the court the option of taking on the case. What’s remarkable here is that Roberts has also placed an eight day hold on the contempt citation that the mystery company has hanging over it. Wait a minute, what contempt citation?




Therein lies the mystery. This company’s failure to cooperate has prompted a judge to hold it in contempt and begin hitting it with monetary fines, in an effort to force it to cooperate. This tells us that this has been a far uglier battle than we imagined, and that the company has gone to greater lengths to dodge this subpoena than we knew.



Even though there are five conservative Supreme Court Justices, this is not an ideological matter. It’s a matter of interpreting the extent to which a foreign government-owned corporation, which presumably does business in the United States, must abide by legal proceedings in U.S. courts. We don’t know how the Supreme Court will rule on this, if it even takes up the case. But Robert Mueller nearly always wins his court battles. And if the Supreme Court sides with Mueller, he could very soon be getting the evidence he’s been trying to subpoena.

In the infamous words of Richard Nixon, “let’s make one thing perfectly clear.” There is no wall. There has never been a wall. No part of Donald Trump’s wall has been built. Ever. None. Not a single piece of steel, not a brick, not one mix of mortar. Nada. Bupkis.




So, when Donald Trump says things like, “A lot of wall has been built,” over and over and over, he is lying, over and over and over. On camera recently Trump actually said this: “A lot of wall has been built, we don’t talk about that but we might as well start because it’s being built right now, big sections of wall.” That is a complete lie. No part of the wall is being built. And when Trump says things like, “we don’t talk about that but we might as well start,” that’s code for a lie. “We don’t talk about that” because there’s nothing to talk about because it’s a lie. It’s Trump’s way of warning us that what he’s saying is a total ad hoc fabrication.


The Washington Post has an expression for this. They call it “Bottomless Pinocchio.” They have given “Bottomless Pinocchio” a specific definition, which is a complete and utter fabrication that has been repeated by Trump at least 20 times. The Post identifies Trump’s claim about the “biggest tax cut in American history” as his largest Bottomless Pinocchio to date, but Trump’s claims about the wall, that it’s being built and has actual physical reality, is not far behind.




Trump’s claim that his narrow theft of the presidency was a stunning victory is another Bottomless Pinocchio. In a recent tweet he wrote, “I won an election, said to be one of the greatest of all time.” No one says that but Trump, of course.



But when it comes to the Bottomless Pinocchio of Trump’s wall, even Fox News is confused. As Laura Ingraham of Fox News recently put it, “I must have missed the wall being built. What wall?” When one of the Trump-crazy talking heads tried to help her out, he said, “I think what he means is they’re upgrading certain parts of the wall …,” Ingraham cut him off. “That’s not a wall, stop saying it’s a wall. There is no wall.”

Donald Trump announced today that he’s turning down James Mattis’ offer to stay on as Secretary of Defense through February, and he’s instead installing Patrick Shanahan as new Acting Secretary of Defense just one week from now. That’s more than a wee bit eyebrow raising, because Shanahan is some kind of Russian puppet. How do we know? Just ask the late John McCain, who had some choice words to say about Shanahan and the Kremlin.




During Patrick Shanahan’s Senate confirmation hearings for Deputy Secretary of Defense in mid 2017, he was grilled by John McCain over his apparent desire to appease Vladimir Putin when it came to Ukraine. At one point, according to the Washington Post, an exasperated McCain said to Shanahan, “Have you not been aware of the thousands of people that have been killed by Vladimir Putin?”




This raises questions as to why Donald Trump chose a guy like Shanahan to be Deputy Secretary of Defense to begin with. At the time he had no prior experience serving in, or overseeing, the military. Instead he was an executive at Boeing of all things. The only thing we can find in Shanahan’s record that would point why Trump chose him? His stated views on how the United States should essentially let Russia have Ukraine.



This comes after Donald Trump announced this week that he was pulling out of Syria, ostensibly in part to appease Vladimir Putin. And of course it’s long been documented that the Trump campaign and Russia had secret meetings at the 2016 Republican National Convention so they could change the RNC platform language to favor Russia over Ukraine. Now that Trump is just weeks away from facing felony counts for treasonously conspiring with Russia, suddenly Trump is rushing to put a Russian puppet in charge of the Pentagon.

When Secretary of Defense James Mattis announced he was quitting this week, he submitted a scathing but dignified resignation letter. He also agreed to stay on until February, thus giving Donald Trump plenty of time to find a replacement and make a smooth transition. It turns out Trump wants no such thing, and he just shoved Mattis out the back door.




Donald Trump is still afraid to publicly attack General Mattis. This isn’t necessarily surprising, as Trump never does attack the military Generals he clashes with. Trump did post a bizarre rant last night attacking President Obama in relation to Mattis. Today, Trump took things further by effectively canceling the final two months of Mattis’ tenure as Secretary of Defense.




Here’s what Trump announced today: “I am pleased to announce that our very talented Deputy Secretary of Defense, Patrick Shanahan, will assume the title of Acting Secretary of Defense starting January 1, 2019. Patrick has a long list of accomplishments while serving as Deputy, & previously Boeing. He will be great!”



It’s possible this will work in favor of the Resistance. Donald Trump is clearly no longer listening to James Mattis one way or the other, so it probably wouldn’t have helped the nation for him to stay on for an extra two months, which probably would have seen him isolated from the White House. Now, when House Democrats begin holding public hearings on Trump’s crimes the first week of January, Mattis will already be out of office, and will thus be in a more unrestrained position when he’s called as a witness.

Last night the mystery company, which has been fighting a Robert Mueller subpoena in appeals court, decided to take up the matter with the Supreme Court. This has led to a discussion about whether the company will be able to keep its identity a secret if it is allowed to argue its case before the Supreme Court. This got me thinking about why the case is being afforded such secrecy to begin with.




We’ve seen the Washington DC Court of Appeals seal off the entire floor during hearings, in order to make sure that the company’s identity remains a secret. Back when it appeared that this case might have been against Donald Trump himself, that made sense. Federal court would conceivably bend over backward to keep secret criminal proceedings against the President of the United States a secret. But now we know that this involves a foreign company owned by a foreign government, and suddenly it doesn’t make sense.




If this company were owned by a government that’s friendly to the United States, there would be no battle here; the evidence would simply be turned over in the name of diplomacy. So this is, by definition, a hostile foreign government. There is no reason to expect that the federal courts would accommodate any request for secrecy. Sure, the company is obviously aligned with Trump, but that wouldn’t be a reason for the courts to make an exception.



The more I look at this, there’s only one reason the courts would provide this much secrecy to this case: Robert Mueller wants it that way. Why? You’d have to ask him. Maybe he doesn’t want Donald Trump knowing who the foreign company/government is, so that Trump can’t go and place pressure on it. Maybe there’s another reason. But this secrecy almost has to be at Mueller’s request.
