Donald Trump lost on Wednesday. Badly. He decided to announce that he would simply show up to the House and deliver his State of the Union address even without Speaker Nancy Pelosi’s approval, thus gambling that Pelosi would back down and let him get away with it. Instead, Pelosi reminded the nation that Trump can’t do that without a House concurrent resolution first, which she has no intention of giving him. Accordingly, Trump launched into a berserk late night meltdown about it.





Sometime after 11pm eastern time, Donald Trump posted this two-part rant: “As the Shutdown was going on, Nancy Pelosi asked me to give the State of the Union Address. I agreed. She then changed her mind because of the Shutdown, suggesting a later date. This is her prerogative – I will do the Address when the Shutdown is over. I am not looking for an alternative venue for the SOTU Address because there is no venue that can compete with the history, tradition and importance of the House Chamber. I look forward to giving a “great” State of the Union Address in the near future!”





So where does this leave us? Make no mistake about it. For all his angry bluster and bravado in the above statement, Donald Trump just caved. He agreed to essentially forfeit his opportunity to address the nation and try to steer Americans toward siding with him on his government shutdown and racist border wall.



Donald Trump set himself up for failure, and Nancy Pelosi won simply by standing her ground. By caving on the State of the Union, Trump just inched himself closer to having to cave on his government shutdown, which in turn puts Trump closer to ouster from office. When it comes to negotiating a deal, Trump is an all-time weakling, and he just reminded us of it yet again.

Back when Donald Trump first revealed that he was hiring John Bolton to be his White House National Security Adviser, most political observers opined that it must have something to do with starting some unspecified land war. Palmer Report pointed out that Bolton had just gotten exposed in the Trump-Russia scandal, and that Trump was obviously hiring Bolton to keep him from flipping, and that Bolton would end up going down anyway. In this instance, we love to say we told you so.





At the time, we didn’t think it was particularly difficult to piece together what was really going on. Cambridge Analytica, which had deep financial ties to John Bolton and deep connections to Russia, had just been pulled front and center in the Trump-Russia scandal. Russian spy Maria Butina had also just come to the forefront of the Trump-Russia scandal, as had her close ties to Bolton. There was no longer any question that Bolton was an agent of Russia on at least some level. Just as this became clear, Trump decided to bring Bolton into the fold.





On Wednesday, new House Oversight Committee Chairman Elijah Cummings revealed that he’s targeting John Bolton for his numerous ties to the Trump-Russia scandal and to the Kremlin. This is a big deal because, while we’ve always assumed Special Counsel Robert Mueller was busy getting to the bottom of Bolton’s role in the scandal, there has been virtually no mainstream public discussion of Bolton’s status as a Russian agent. That’s about to change in a big way.



For instance, as a result of Elijah Cummings’ announcement, Rachel Maddow devoted most of the first segment of her MSNBC show on Wednesday night to laying out John Bolton’s ties to Russia. As we’ve learned, where Maddow takes things, other TV hosts and pundits end up tending to follow. Once the House Oversight Committee begins holding public hearings into Bolton, it’ll become a front page story. It’s clear Bolton is going down; now we know that he’s going to go down in public.

As Special Counsel Robert Mueller keeps closing in on Donald Trump and his numerous henchmen, some of them have cut plea deals against each other, while others are still trying to find a way to hold their ground. In an unusual move, MSNBC decided to have four of Trump’s Russia-Connected associates on air together this evening. It didn’t go well for them – at all.





Host Ari Melber invited former Donald Trump political advisers Sam Nunberg, Michael Caputo, and Carter Page, along with Trump-connected conspiracy theorist Jerome Corsi, on air for a joint interview. The four of them initially tried to jointly paint themselves as all being victims of a Robert Mueller witch hunt, but it didn’t take long for their solidarity to collapse, and they quickly began turning on each other.





Corsi and Nunberg began blaming their former friend Roger Stone for their troubles. This prompted Caputo to defend Stone, and to openly accuse Corsi of lying, telling him to drop his “George Washington” act. This came even as Melber played earlier clips of them contradicting themselves. For much of this three-way argument, Carter Page just sat there uncomfortably, as if he’d accidentally wandered onto the set by accident.



When it was finally Carter Page’s turn, he acknowledged that he’s associated with Russian spies, while still insisting that he’s done nothing wrong, and that the Trump-Russia probe is one big conspiracy against him. It’s not clear what any of these four individuals were trying to accomplish by agreeing to this joint appearance – but they all came away worse for wear.

“President” Donald Trump has informed Speaker of the House Nancy Pelosi that he will deliver his State of the Union address from the House chambers, despite her telling him no. Trump again shows his ignorance of history and how any of this works. The president has no privileges on the House floor.





What must happen is that Pelosi must bring a concurrent resolution that is needed to hold a joint session of Congress. The concurrent resolution must then be adopted by both chambers for there to be a joint session. And the Senate will not work either, without both chambers signing off and adopting such a resolution. Apparently, the Mad King thinks he can do as he pleases. He cannot and allowing him to move forward would be unprecedented and a dangerous encroachment on the institutions set up by our United States Constitution.


The Constitution requires no public event or a speech, providing in Article 2, Section 3: “He shall from time to time give to the Congress Information of the State of the Union….” Trump could theoretically convene a joint session as Article 2, Section 3 also provides: “he may, on extraordinary Occasions, convene both Houses, or either of them….”





However, the humanitarian crisis or the shutdown, both of which Trump is responsible for (to the extent there is a humanitarian crisis at border, it is the policies the Trump administration is enforcing), do not appear to rise to an extraordinary occasion. The last time this provision was used was in 1948, when President Truman convened both houses regarding a variety of laws he wished to be passed. Congress was adjourned at the time.



The main triggering event is that Congress is “not in session and that an extraordinary occasion has arisen which requires that it be in session,” according to an opinion from 1947 by the Attorney General at the time. Here, Congress is in session. So, no Mad King, there is no authority for you to enter the House chamber without a concurrent resolution, as the Congress is in session and not adjourned. If you do so, you may be committing trespass.

Even though nothing works that way, Donald Trump decided to announce today that he’s going to simply show up to the House and give his State of the Union address without the House’s permission. Speaker Nancy Pelosi promptly told him to a take a hike accordingly. This prompted Democratic Congressman Eric Swalwell to pile on with one of his best lines yet.





There is nothing funny about Donald Trump’s government shutdown, or the nearly one million federal employees who have stopped getting their much needed paychecks, or any of the other negative consequences of Trump’s hostage-taking. But Trump loves to keep his braindead base fired up with simplistic zingers and such, so there is something to be said for firing back accordingly and exposing him for the witless one-note buffoon that he is.





Accordingly, after Nancy Pelosi rejected Donald Trump’s latest request to show up and give the State of the Union, Eric Swalwell fired off this zinger at Trump: “Take a hint. She’s just not that into you and your shutdown.”




Swalwell also went on to explain some of the logistical reasons why Donald Trump shouldn’t be allowed to give his State of the Union address while he’s refusing to allow employees to get their paychecks: “As the son of a cop, I deeply respect our law enforcement officers. No cop should have to work without pay to protect a ‘national security event’ speech. Let’s open up government. Until then, don’t risk your lives for free for me.”

After Donald Trump shut down the government and took America hostage, Speaker Nancy Pelosi informed him that he would not be invited to show up to the House and give the State of the Union until he ended his shutdown. Trump thought he would be clever today by simply announcing that he’s going to show up and give it anyway. In response, Pelosi promptly beat him at his own game.




Although it’s widely regarded as mere tradition and formality, the President of the United States can’t actually enter the House chamber and give the State of the Union without the House’s permission. Pelosi took advantage of that fact this afternoon when she fired off a public letter to Donald Trump.






Pelosi’s brief letter stated in part: I am writing to inform you that the House of Representatives will not consider a concurrent resolution authorizing the President’s State of the Union address in the House Chamber until the government has reopened. Again, I look forward to welcoming you to the House on a mutually agreeable date for this address when government has been reopened.”



Donald Trump then threw a tantrum about it in front of the television cameras, which was a de facto admission that he has no idea what to do next. Nancy Pelosi has managed to further back Trump into a corner, at a time when his approval rating is at an all time low, and most Americans accurately blame him for his shutdown.
