Republicans and conservatives too often fail to consider the precedent they’re setting when they defend Donald Trump. Take Trump’s tax returns for example, or rather Trump’s failure to release his tax returns.


On the campaign trail, Trump promised to release his tax returns as soon as he became president. Once Trump won the Republican nomination, his excuse quickly morphed into a promise to release them as soon as the IRS completed a supposed audit, although there is nothing that prevents him from releasing his taxes even if he is being audited. Once he became president, Trump’s excuse changed for a third time. At that point Trump said his tax returns were just ‘too complicated’ for people to understand, and releasing them would just cause confusion and misunderstandings.




There has been much speculation regarding the real reason Trump won’t release his tax returns. One theory is that Trump is not worth the billions he claims to have, and that he’s possibly even broke. Other theories say he’s deeply in debt to countries like Russia and/or Saudi Arabia. Still others state that Trump has engaged in a wide variety of illegal tax schemes throughout the years to avoid paying all the taxes he was responsible for, and releasing his taxes would show this to be fact.




Donald Trump’s refusal to release his taxes, as well as his constantly shifting excuses for not doing so, are a clear indication that there is something there he does not want the public to learn. In a failure to utilize long-term thinking, and despite all the possible irregularities and/or illegalities that could be exposed by Trump’s tax returns, many Republicans still defend the fact that Trump refuses to release them.



In defending Trump’s refusal to release his tax returns now, Republicans are effectively arguing that no future presidents, including Democratic presidents, will be required to release their tax returns either. In their eagerness to defend all things Trump, Republicans regularly fail to consider the precedent they are setting for the future, and those failures could leave them with many future regrets.

When the Senate Intelligence Committee’s Republican Chairman Richard Burr made the absurd announcement earlier this week that his committee had found no direct evidence that the Trump campaign colluded with Russia during the election, Palmer Report made two predictions. First, it would have no impact on anything. Second, it meant that Burr and Team Trump were expecting Special Counsel Robert Mueller to drop the hammer at any moment.




Sure enough, Senator Burr’s claims haven’t ended up moving the needle in any noticeable way. More importantly, it turns out Burr really was making the “no evidence of collusion” claim because he knew that he was about to lose the ability to make such a claim. As Chairman, Burr has access to classified and sensitive information, and he must have known what was coming, but sure enough, Robert Mueller just produced proof of collusion and worse.




In a court filing this evening, Robert Mueller revealed that he’s obtained proof that Roger Stone was communicating with WikiLeaks and Russian government hackers during the 2016 election, for the purpose of transporting stolen information. In other words, not only does this prove that Stone committed treason (or its peacetime equivalent), it proves that the uppermost levels of the Donald Trump campaign conspired with the Kremlin to alter the outcome of the 2016 election.



In other words, not only was there serious criminal (and provable) Trump-Russia collusion, it also means that Donald Trump isn’t even legitimately the President of the United States. Perhaps most importantly, Mueller’s decision to reveal this proof of collusion in an unredacted manner today suggests that he’s ready to take Trump down entirely.

It was fairly clear that Paul Manafort’s life was effectively over when a federal judge ruled this week that he had indeed willfully violated his plea deal by lying about his meeting with a Russian spy during the 2016 election. But this evening Mueller truly drove the point home about how screwed Manafort is.




Robert Mueller has made a court filing recommending that Paul Manafort be sentenced to 19.5 to 24.5 years in prison. Based on the way these things tend to play out, that’s probably about what the judge will end up giving him. Considering that Manafort is about to turn seventy years old, this will be a de facto life sentence with no possibility of parole. It gets even worse for him.




All along, Donald Trump’s actions have given no indication that he has any intention of taking the risk of trying to pardon Paul Manafort, which could backfire and end up establishing a legal precedent that Trump can’t pardon himself or his kids. Even if Trump did try to pardon Manafort, parallel state level charges would be brought against Manafort, and those can’t be pardoned.



Legal observers thought that Paul Manafort could have gotten five years in prison or less if he had lived up to his plea deal, which could have given him a chance of getting out before he dies of old age. But now Manafort is simply done for. There’s no less blunt way to put it. The other people who have been covering for Donald Trump should take note of this accordingly: cut a plea deal or you could be the next Manafort.

Have you heard these questions? Why Donald Trump doesn’t pivot and try to appeal to a larger number of supporters? Why doesn’t he consider the more moderate voters and behave in a way that could potentially grow his number of supporters?

Anchors like Stephanie Ruhle on MSNBC are debating these questions in regard to the current funding compromise. Trump should support the current funding compromise which includes funding for the building of a limited number of miles of fence. Without declaring an emergency Trump can still find some additional money for his wall, and he has been claiming the wall is already being built. Why declare a national emergency that most of his Republican congressmen don’t want, and that will surely be stopped in courts? Why does Trump continue to take the most extreme, politically unfeasible positions? As possible explanations, pundits cite Trump’s narcissism, his obsession with news coverage, and his fear of criticism from the likes of Ann Coulter, but they miss his real, strongest motivator.

Trump has lived his entire life like a bad American Greed episode (if you’ve never seen it you should). He is always just a few steps away from disaster: bankruptcy, debt collectors, money laundering charges, the wrath of Russian mafia, and now serious criminal charges. Like a true career criminal, Trump has energy and clarity only when he is desperately running from impending doom. He has negotiated his way out of serious money laundering charges in the past. He can strong arm financial institutions, and pay pennies on the dollar of what he owes to bankers and contractors. He has found bigger, meaner, nastier criminals to partner with to get himself out of bankruptcy, while he buried himself deeper into the bowels of Russian mafia. There is no evidence to support the idea that Trump has devoted time or energy to normal political concerns. Instead, he has devoted nearly all his energy to getting out of the personal, financial and criminal mess he faces.


His actions suggest he is concentrating on two possible ways out of the mess. The first is to go all in on corruption and lies and hope he can ensnare enough powerful people with him, to get political cover and get away with everything. You can see his attempts at this, courting people like Jeff Sessions, Preet Bahrara, and Jim Comey, cornering them into inappropriate conversations. Seeking assurances of loyalty from them while promising to retain them in his administration, only to fire them all when it became clear they would not provide him cover. Then, he replaced them with people he expected to do his bidding, and provide him cover. While Trump continues to make increasingly desperate attempts at this approach, ultimately it is not working and he knows it.




The second way out for Trump is less desirable for him, but is more realistic. Trump knows there will come a time (soon) when he will be exposed and he will be facing not only impeachment, but criminal charges for him and his children. At that time, any support from moderates he could have gained will disappear. Reasonable moderates will not stay with him in the face of legitimate evidence of criminal conduct. However, he will still have the most rabid of his base, who are prone to believe that he was set up by the FBI.




The spill-into-the-street support of his gun-carrying base will some day be his last negotiating chip. He will be able to offer to prosecutors and politicians, that he will put down his phone and stop tweeting, and resign in exchange for leniency for him and his kids. The more his base is all-in and fired up in their support of him, the more powerful a negotiating chip he has.



Donald Trump can’t afford to have his most avid supporters back off even a little in the intensity of their support of him. Trump is likely to demonstrate the power he holds over his base by firing off tweets and calling for demonstrations. Prosecutors and politicians will have to consider what is best for the nation, and having the most avid members of his base marching in the streets and believing the deep state set Donald Trump up, is not a good situation for the nation. This is why Trump consistently chooses to rile up the most fervent of his base instead of courting moderate voters.

We’ve seen it time and time again. One of Donald Trump’s underlings gets backed into a legal corner as a result of doing Trump’s bidding, and then has to decide whether to remain loyal or cut a plea deal against Trump. Whenever it happens, Trump dangles something at that person – a new job, an imaginary pardon, you name it – in the hope of preventing that person from flipping. Now it’s happened with Matt Whitaker.




This week the House Judiciary Committee publicly informed Matt Whitaker that it had found proof he was lying when he claimed under oath that he had never discussed the Robert Mueller probe with Donald Trump. This was a polite way of letting Whitaker know that he’s going to prison for felony perjury unless he cuts a plea deal against Trump and/or publicly confesses to Trump’s obstruction crimes during followup hearings.




This occurred just as Matt Whitaker’s time as Acting Attorney General is coming to an end. So now Donald Trump has decided to hire Whitaker permanently as a “senior counselor” at the Department of Justice, according to Bloomberg. So what does a senior counselor do? In this instance, Whitaker will likely get paid to just sort of be there, since he’s already proven he’s not good at anything.



This isn’t the first time Donald Trump has given one of his associates a new or better job, just as the person was coming under legal scrutiny in Trump-related scandals, and was thus going to need to decide whether to cut a plea deal. For instance, Trump hired John Bolton as National Security Adviser just days after the Bolton-connected company Cambridge Analytica got busted.
