In the hours since Donald Trump’s DOJ mouthpiece William Barr released a laughably misleading “summary” of Robert Mueller’s report, we’ve been fortunate that numerous major media outlets have been willing to poke holes in Barr’s fish story, as opposed to merely repeating it as if it were fact. That said, a different narrative has developed tonight – particularly among TV pundits – about how Congress blew it by putting all its eggs in Mueller’s basket. But the facts suggest something rather different.



Let’s hypothetically say that there never was a Robert Mueller investigation to begin with. The Democrats didn’t take control of the House until two and a half months ago, and the first month of it was dominated by necessary procedural matters. So if the House Democrats were the only people investigating Trump’s crimes and scandals, the earliest they could have gotten started with it would have been in February.




It turns out they did get started with it in February, when Michael Cohen publicly testified about various Trump crimes. So the House Democrats didn’t actually lose any time at all by “waiting” for Robert Mueller to finish. They’re on just about the same timeframe they would have been if Mueller’s probe never existed. The difference is that, because Mueller did what he did, people like Cohen got busted, and ended up being willing to testify against Trump in front of Congress and the public.


There’s certainly reason to argue that House Democrats would have been better off today if the (real) Mueller report became public, as opposed to Barr’s nonsensical “summary.” We’ll see how quickly the Democrats can use their subpoena power to get their hands on the report. In the meantime, it’s difficult to argue that the House Democrats have lost any opportunities as a result of the Mueller probe. It’s just going to be a matter of how much or little they’ve gained from it.

If Donald Trump’s marionette Attorney General William Barr had released an even remotely accurate or truthful summary of the Robert Mueller report today, Mueller could probably have simply gone back to retirement. But because Barr released a hilariously false “summary” that has legal experts rolling their eyes, and the public and the media ferociously demanding answers, Mueller is about to come back front and center in a way we’ve never before seen.



Look for House Democrats to very quickly do two things. They’ll subpoena the Mueller report itself, which will set up a legal battle – and perhaps negotiations – about how much of it Barr will have to turn over. They’ll also subpoena Barr, and force him to testify about why he’s misleading the public about what the report says. If Barr refuses, he can be held in contempt of Congress and arrested, and you’d better believe there’s enough of a public appetite to support such a move. But that’s nothing compared to what’ll come next.




For months, various House Democrats have publicly stated that if the Trump regime tried to bury the Mueller report, they would simply subpoena Robert Mueller to publicly testify about what his report says. Now that the Trump regime is indeed playing the worst of games with the report, there is no doubt House Democrats will bring in Mueller to testify, because they can make that happen quicker than they can forcibly get their hands on the report.


There is every reason to expect that Robert Mueller will cooperate with such a subpoena, and no reason to expect that Trump or Barr can stop it. Mueller will only be willing to testify publicly about the parts of his report that aren’t part of ongoing investigations. But beyond that, everything will be on the table. Just about the entire world will tune in to hear Mueller speak, and it may end up being a more effective blow to Donald Trump than if Mueller’s report had simply been published to begin with.

When Special Counsel Robert Mueller announced on Friday that his work was complete and that he wasn’t recommending any more indictments, Palmer Report pointed out what we thought was obvious: if Mueller was stepping off the stage, he was handing off (or already did hand off) his ongoing investigations to permanent federal prosecutors in order to ensure that justice would be served. It turns out we’re already getting confirmation of some of this.



For instance, Law & Crime has pieced together the details of two different New York Times stories, and figured out that federal prosecutors based in Los Angeles are currently investigating the Donald Trump inauguration scandal. Best anyone can tell, the inauguration probe – which allegedly involves numerous illegal foreign donations, and an alleged attempt by Trump at steering the money back into his own business – began when federal prosecutors in New York raided Michael Cohen’s office and found a tape recorded conversation about inauguration funds.




The recently released search warrant from the Cohen raid revealed that Robert Mueller initiated the Cohen investigation, only to find that Cohen didn’t conspire with Russia, but that Cohen did commit other Trump-related crimes. Mueller then handed off the Cohen case to the Feds in New York, and their raid has since led to the Feds in Los Angeles investigating the Trump inauguration.


This thread alone makes clear that Robert Mueller’s investigation has set off other federal investigations into alleged Trump-related crimes. So the idea that Mueller’s investigation is “complete” or “wrapped up” is nonsense. It’s just that Mueller is no longer in charge of any of the ongoing investigations. Notably, the existence of these investigations only tends to become public knowledge once they reach the point where something such as a raid causes it to become public knowledge. So we don’t know just how many Mueller-spawned criminal investigations into Trump scandals are ongoing – but the number isn’t zero.

If Donald Trump’s puppet Attorney General William Barr had released an even halfway believable “summary” of Robert Mueller’s report, more people might be falling for it. But because Barr had to release such an obviously and cartoonishly inaccurate summary, it’s taken all of minutes for the public, the media, and the politicians to begin poking mile-wide holes in Barr’s attempted coverup.



Senator Richard Blumenthal, who sits on the Senate Judiciary Committee, appeared on MSNBC on Sunday evening and minced no words: “This letter is elegantly but brazenly devious. What [Bill] Barr has done is essentially to frame the message before the facts are available, before the substance is accessible. He has in effect created headlines that will create a trap for all of us.” Blumenthal was just getting started.




The Senator went on to offer a plausible explanation for why Barr’s summary might be claiming that Mueller found no collusion: “The crime of obstruction is designed to prevent destruction of evidence, whether it’s witness tampering or document destruction. So the finding here that there was insufficient evidence to establish collusion may be the result of that obstruction.” There’s also a different theory about Barr having limited his collusion claims to the Russian government itself, as opposed to Russian government representatives.


Senator Blumenthal also seemed to hint that the Democrats could subpoena Trump to testify: “One question I have, which really hasn’t been explored, is why the Special Counsel did not force an interview with Donald Trump. You mentioned earlier that there have been thousands of subpoenas. Why not a subpoena for Donald Trump? I have great respect for Bob Mueller, but I said from the very start that Trump has to be interviewed under oath, just as other presidents have been before.” The Senate Judiciary Committee won’t do that, but the House Judiciary Committee certainly can.
